1. Purpose

The purpose of these General Terms and Conditions of Sale is, on the one hand, to inform any potential consumer of the terms and conditions under which the seller proceeds with the sale and delivery of the products ordered, and on the other hand, to define the rights and obligations of the parties in the context of the sale of products by the seller to the user, which apply, without restriction or reservation, to all sales by the company SAW of the products offered on its websites “qthdriver.com” and “shop.qthdriver.com”.

Consequently, the fact that any person orders a product offered for sale on the SAW website implies full and complete acceptance of these General Terms and Conditions of Sale, which the buyer acknowledges having read prior to ordering. The products are offered for sale on the following geographical territory: Metropolitan France / Europe.

Prior to placing an order, the buyer declares that he/she has the full legal capacity to commit to these General Terms and Conditions of Sale. SAW reserves the right to modify these General Terms and Conditions of Sale at any time.

3. Access to the Site

The buyer is personally responsible for the installation of the computer and telecommunication means allowing access to the “qthdriver.com” and “shop.qthdriver.com” websites. The buyer shall bear the telecommunications costs when using the site.

4. Agreement and Orders

4.1. Prices

The sale prices of the products online on the “shop.qthdriver.com” website, indicated in Euros, are those in force at the time of registration of the order form by the buyer. The price of the products on the site is guaranteed only for online payments by credit card.

The prices displayed are exclusive of VAT and free of charge, the VAT will be incremented and visible in the shopping cart, it appears separately on the order, at the time of payment, it is applicable on the day of the order and any change in the applicable VAT rate will be automatically reflected in the price of the products sold by “shop.qthdriver.com” within its website. The selling prices of the products can be modified by “QTH Driver SAW” at any time. The buyer will be informed of this modification before placing an order.

4.2 Product Characteristics – Availability

In accordance with Article L 111-1 of the French Consumer Code, the buyer may, prior to placing an order, take note, on the “QTH Driver SAW” website, of the essential characteristics of the product(s) he wishes to order. The buyer selects one or more products from the various categories offered on the “shop.qthdriver.com” website.

The offers presented are valid while stocks last. “QTH Driver SAW” reserves the right to modify the product range according to the constraints of its suppliers.

The photographs and graphics of the products offered for sale are indicative only and are not binding on the seller.

In the event that a supplier modifies a product, the seller shall not be liable for the graphic representation of the product, nor shall it affect the validity of the sale.

4.3. Order

All orders imply full and unreserved acceptance of these General Terms and Conditions of Sale.

From the moment the buyer has registered his order by clicking on “I acknowledge having read and accepted the GTC”, he is considered to have accepted with full knowledge of the facts and without reservation the present General Terms and Conditions of Sale, the prices, volumes and quantities of the products offered for sale and ordered.

The buyer’s order must be confirmed by “QTH Driver SAW” by e-mail.

The sale will only be considered as final after “shop.qthdriver.com” has sent the buyer a confirmation of the order and has collected the full price.

“shop.qthdriver.com” recommends the buyer to keep this information on a paper or computer document.

5. Payment of the Price

The payment of the totality of the price must be made at the time of the order by the buyer. At no time can the sums paid be considered as a deposit or advance payment. The collection of the total amount of the order will be made by “QTH Driver SAW” at the time of the validation of the order.

All orders are payable in Euros.

To pay for his order, the buyer has all the means of payment referred to in the order form: Stripe bank card. As part of the fight against Internet fraud, information relating to your order may be transmitted to any third party for verification.

6. Choice of Products

The buyer, having acquainted himself with the products and their characteristics marketed by “QTH Driver SAW”, has under his sole responsibility and according to his needs as determined before any order, made his choice on the product(s) which are the object of his order. In addition, the buyer, knowing the equipment, configurations and other, which he uses, is the sole judge of the compatibility of the products ordered with those used by him.

It is the sole responsibility of the buyer to seek legal advice if he does not consider himself sufficiently competent.

7. Delivery and Acceptance

7.1 General Rules

The products will be delivered to the address indicated by the buyer when ordering. The buyer may, at his express request, obtain the invoice at the billing address and not at the delivery address by validating the option provided for this purpose at the “address” stage.

“QTH Driver SAW” offers its customers delivery by the French postal services (La Poste). If the procedures set out below are not followed, no complaint from the buyer will be accepted.

7.2 Features of the French Postal Services (La Poste)

The buyer receives his order at the address he has indicated as the delivery address. In the event that the buyer has any doubts whatsoever about the condition or content of the package, he must report these incidents to “QTH Driver SAW”.

7.3 Deadlines

The average deadline from the “QTH Driver SAW” depot is as follows: La Poste from 3 to 5 days. This time is given as an indication.

7.4 Quality or compliance issues

In case the manual is not delivered with the product, “QTH Driver SAW” will send the manual in French or a link to access it on request of the consumer.

All products offered for sale benefit, where applicable, from the legal guarantee provided for in articles 1641 et seq. of the French Civil Code.

In addition, you also benefit from the guarantee of conformity of the products, provided for in articles L. 211-4 and following of the Consumer Code.

The action resulting from the lack of conformity is prescribed by two years as from the delivery of the product.

The time limit for acting on the basis of a latent defect is 2 years from the discovery of the defect.

If repair and replacement of the product is not possible, you may return the product and receive a refund.

Complaints must be sent by e-mail: mike@qthdriver.com and include the order number and the reasons for the complaint regarding the product concerned. Following an exchange with the customer service of “QTH Driver SAW” you will receive a return number. This return number is a crucial and necessary condition and is valid seven working days after “QTH Driver SAW” has communicated the return number to the buyer. After this period, the buyer will have to renew his request, according to the procedure described above.

Any product to be exchanged must be returned to “QTH Driver SAW” in its original condition and packaging, with all the product and its accessories, and must be accompanied in a legible manner by the product return number communicated by “QTH Driver SAW” and the product serial number.

Any product that is incomplete, damaged and/or whose original packaging has been damaged will not be accepted for return or exchange under the guarantee.

The shipping costs are at the customer’s expense. Any risk related to the return of the product is at the buyer’s expense. If the above procedure is not followed and the time limits indicated are not respected, the buyer will not be able to make any claim for non-conformity or apparent defect of the products delivered, the products being then deemed to be in conformity and free of any apparent defect.

In any case, the guarantees do not cover abnormal and improper use of the products.

8. Product Availability

In case of unavailability of the ordered product, “QTH Driver SAW” will inform the buyer as soon as possible.

In any case, the ordered products will be delivered within a maximum of thirty days from the day following the day on which the buyer has registered his order, subject to full payment of the price.

If “QTH Driver SAW” fails to make use of this option, the buyer will be reimbursed without delay and at the latest within thirty days of payment of the sums he has paid.

9. Right of Withdrawal

In accordance with article L 221-18 of the French Consumer Code, the buyer has a period of fourteen clear days from the date of receipt to return the ordered products at his own expense, for reimbursement, without having to justify his reasons. If this period expires on a Saturday, Sunday or public holiday, the right is extended to the next working day.

The products must be returned to “QTH Driver SAW” in perfect condition for resale, in their original state (packaging, accessories, instructions, etc.), duly sealed, and accompanied by the invoice corresponding to the purchase.

Similarly, if the product includes a guarantee sheet or any other document to be completed, this does not need to be filled in for the buyer to exercise his right of withdrawal.

Any product that is incomplete, damaged or whose original packaging has been damaged will not be refunded or exchanged.

An unambiguous statement expressing your wish to withdraw from the contract. You can use the withdrawal form (Annex 1). However, this is not compulsory.

In order to comply with the withdrawal period, it is sufficient to send us the declaration of withdrawal before the expiration of the withdrawal period.

If you exercise your right of withdrawal, we shall be obliged to refund all sums already paid by you promptly and at the latest 14 days after the date on which we were informed of your decision to withdraw. We will use the same method of payment for this refund as you used for the original transaction, unless you give your express consent for us to use another method of payment and provided that the refund does not incur any costs for us.

You will not have to pay any penalties.

10. Reservation of Ownership

“QTH Driver SAW” retains full ownership of the products sold until full payment of the price, including all costs and taxes.

During the period between delivery and transfer of ownership, the risk of loss, theft or destruction shall be borne by the buyer.

If the buyer fails to fulfil his payment obligations, the seller has the right to demand the immediate return of the goods delivered at the buyer’s expense and risk.

11. Liability

The products offered by “QTH Driver SAW” comply with the French legislation in force.

“QTH Driver SAW” cannot be held responsible for the non-performance of the contract in case of stock shortage or unavailability of the product, force majeure, disturbance or total or partial strike, in particular of Chronopost and means of transport and/or communications. “QTH Driver SAW” cannot be held responsible for any indirect damage that may occur as a result of the purchase of the products. QTH Driver SAW” shall not be held liable for the total or partial inability to use the products, in particular due to incompatibility of equipment, nor shall it give rise to any compensation or refund.

The “shop.qthdriver.com” website also contains information from third parties and links to other websites. “QTH Driver SAW” shall in no event be liable for any damages resulting from the use of, access to, or inability to use such third-party information or the content of such other websites.

12. Partial Invalidity

If one or more provisions of these General Terms and Conditions of Sale are held to be invalid or declared as such in application of a law, a regulation or following a final decision of a competent court, the other provisions shall retain all their force and scope.

13. Non-waiver

The fact that one of the parties does not avail itself of a breach by the other party of any of the obligations referred to in these General Terms and Conditions of Sale shall not be interpreted for the future as a waiver of the obligation in question.

14. Applicable Law

The sales of products of the company “QTH Driver SAW” are subject to French law.

15. Information Technology and Civil Liberties

When you order a product, personal information about you may be collected and processed.

SAW is responsible for the processing of the data collected and declares that it complies with its obligations in this respect and guarantees this to you.

The information collected during any order from the buyer is necessary for the execution of the contract between you and “QTH Driver SAW”, in accordance with Article 6.b of the European Regulation 2016/679 and its commercial partners. In accordance with the French Data Protection Act n°78-17 of January 6^th, 1978, the buyer has the right to access, rectify, oppose and delete data concerning him/her at “QTH Driver SAW”.

17. Dispute Resolution and Jurisdiction

In the event of failure to file a claim with SAW or in the absence of a response from the latter within two (2) months, you may submit the dispute relating to these General Terms and Conditions of Sale between you and SAW to a mediator who will attempt, in complete independence and impartiality, to bring the parties together with a view to reaching an amicable solution, in accordance with Articles L.612 et seq. of the French Consumer Code.

18. Litigation

In the event of a dispute concerning the interpretation, execution or validity of these General Terms and Conditions of Sale, the competent court shall be determined in accordance with the applicable legal provisions.
